Policy
By using the myskillsmap.com web site ("Service"), a service of Monnet-USA. ("Monnet-USA"), you are agreeing to be bound by these terms and conditions ("Terms of Service").
Monnet-USA reserves the right to update and change the Terms of Service from time to time without notice by posting updates and changes to the myskillsmap website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you. Any new features that augment or enhance the current Service, including the release of new features and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
Violation of any of the Terms of Service below will result in the termination of your Account. While Monnet-USA prohibits such conduct and Content on the Service, you understand and agree that Monnet-USA cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk.
Account Terms
- You must be 18 years or older to use the Service.
- Your account must be registered by a person. Accounts registered by automated methods are not permitted.
- You must provide your full legal name, current billing address, a valid email address, and any other information needed in order to complete the signup process.
- Your account may only be used by one person. A single account shared by multiple people is not permitted. Each person within a company must have his or her own user account.
- One person or legal entity may not maintain more than one trial account.
- You are responsible for keeping your password secure. Monnet-USA cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
- A breach or violation of any of the Account Terms as determined in the sole discretion of Monnet-USA will result in an immediate termination of your account.
Content Terms
- You may not use the MySkillsMap service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of the U.S.A.
- You are responsible for all activity and content (data, graphics, photos, links) that is uploaded under your MySkillsMap account.
- We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
- You must not transmit any worms or viruses or any code of a destructive nature.
- We do not claim any intellectual property rights over the material you provide to the Service. Your profile and any Content created under your account remain yours. You can remove your Content at any time by deleting your account. This will also remove all content you have stored on the Service.
- Monnet-USA does not pre-screen Content, but Monnet-USA and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Monnet-USA.
Modifications to the Service and Pricing
- Monnet-USA reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
- Monnet-USA shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
- Prices for using MySkillsMap are subject to change upon 15 days notice from Monnet-USA. Such notice may be provided at any time by posting the changes to the pricing page of the MySkillsMap Web Site (myskillsmap.com) or the logged in user home page via an announcement.
Payment, Refunds, Account Upgrade and Downgrade
- A PayPal account is required for fee-based accounts (Personal, Pro, and Business). Trial accounts do not require a PayPal account.
- If you upgrade from a trial account to any fee-based account, you will be charged for your first month immediately upon upgrading.
- The Service is billed in advance on a 30 day interval and is non-refundable. No refunds or credits will be provided for partial months of service, downgraded accounts, or months unused with an open account.
- You will be billed on the day where you sign-up for a fee-based service or upgrade your service.
- When your billing period is over MySkillsMap users will be sent an invoice via email and an invoice will appear on your account page. Customers have approximately two weeks to bring up and settle any issues with the billing.
- If you do not provide payment, Monnet-USA reserves the right to immediately deny access to your account until payment is received.
- All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.
- If you upgrade your account, you will be immediately charged the prorated difference between your current plan and the newly-selected plan. On your next billing cycle, you will be charged the full amount of the new plan
- If you downgrade your account to another fee-based account, you will be charged the amount of the newly-selected plan on your next billing cycle. You will not receive a refund for the difference in plan prices for the partial month.
- Downgrading your Service may cause the loss of Content, features, or capacity of your Account. Monnet-USA does not accept any liability for such loss.
- If you choose to downgrade your account, your Account must fit within the restrictions (number of projects per year, number of actiities per project, etc.) of the new plan selected. We will automatically retain the most recent content to match the new restrictions and purge older content exceeding the restrictions.
Cancellation
- You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not considered cancellation. You can cancel your account at any time by clicking the Cancel My Account link from your Account page.
- All of your Content will be immediately deleted from the Service upon cancellation. Your content cannot be recovered once your account is cancelled.
- If you cancel the Service before the end of the month for which you have already been billed, the difference in unused days will not be refunded.
Termination
- We reserve the right to modify or terminate the My Skills Map service for any reason, without notice at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account.
- Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Monnet-USA customer, employee, member, or officer will result in immediate account termination.
- Without limiting any other remedies, Monnet-USA may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.
General Conditions
- Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.
- Monnet-USA reserves the right to refuse service to anyone for any reason at any time
- We reserve the right to modify or terminate the Service for any reason, without notice at any time.
- Technical support is only provided to paying account holders and is only available via email or the support forum.
- You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Monnet-USA, or any other Monnet-USA service.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Monnet-USA.
- You understand that Monnet-USA uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
- You understand that the technical processing and transmission of the Service, including your Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit Card information is always encrypted during transfer over networks.
- We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
- Monnet-USA does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected
- You expressly understand and agree that Monnet-USA shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Monnet-USA has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
- If any provision of these Terms Of Service or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the such documents remain in full force and effect.
- These Terms and the relationship between You and Monnet-USA shall be governed by the laws of the State of Colorado without regard to its conflict of law provisions, and specifically excluding from application to these Terms that law known as the United Nations Convention on the International Sale of Goods. You and Monnet-USA agree to submit to the personal jurisdiction of the courts located within the county of Clear Creek, Colorado. The failure of Yahoo to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
